Hi, this council tax is raising some issues. its true that Fort Noks are charged a council tax from the time the properties are registered as complete in this case Nessebar Fort Club was registered as from 1st November 2007. Fort Noks are trying to be clever by offering purchasers right of use as from that date then charging their council tax bill to the purchaser.
However, there is nothing in the preliminary contracts that state the purchaser agrees to pay any council tax charges prior to completion. I would also add that Bulgarian law states that the owners are liable for council tax charges as from the signing of the deeds at the Notary. I would also add that the local Municipal charge council tax in Leva not Euro and therefore any council tax charges stated by Fort Noks are very questionable as to the actual amount they really have to pay. So far there has been no documentary evidence shown by Fort Noks for any charges payable to the local municipal, although they strongly state that they have this paperwork. I emailed Head office who were supposed to send me copies some weeks ago and still I have not received them.
It would seem the decision to pay this council tax to Fort Noks is purely down to the individual, I have taken legal advice and was told that it is not normal practice for any developer to charge purchasers council tax prior to completion, or maintenance charges for that matter and that the developer would not be in a position to claim these charges through a civil court, as it does not comply to Bulgarian law.
I have 2 apartments on NFC and I am totally against paying any demands for Council tax payments prior to completion on principal.
